Thoughts From the Left on the Power of SCOTUS

In a previous post, we suggested in reference to the idea of expanding the membership of the Supreme Court that, “If we arrive at a day in which the best strategy in the eyes of Democrats is to kick off yet another political power spiral that will inevitably come around and smack them in the back of the head, it may just be time for progressives to re-examine their assumptions about the role and power of the Supreme Court.”

Matt Bruenig at the progressive People’s Policy Project appears to be doing just that. Read Bruenig’s thoughts on Court-packing and Marbury v. Madison here.

We’re not sure we agree that Marbury could simply be waved away, at least not without precipitating a mammoth constitutional crisis. But Bruenig understands that if filling a vacancy occasions this much angst on the left, then maybe the role of the Court is the issue, not the process of selecting its membership.
